Borenius Co-Authors Journal Article on Arbitration Clauses

Borenius’ dispute resolution lawyers Markus Kokko and Tero Kovanen have co-authored a Finnish article on the validity and operation of optional arbitration clauses published in a Finnish law journal Liikejuridiikka 1/2016.

This article provides an insight into new optional arbitration clauses used in Finland. Recent years have seen the rise of optional arbitration clauses particularly in the field of banking and finance. Internationally, different approaches as to the validity of such arbitration clauses have been adopted. The article examines the validity of these clauses as well as presents a systematic view on their operation under Finnish law.
