Borenius successfully advises the European Natural Soy and Plant Based Manufacturers Organisation (ENSA) in a state aid matter concerning the Finnish Sweets Tax

We represented ENSA in a state aid matter concerning the compatibility of the Finnish Sweets Tax with European state aid regulations. We filed ENSA’s complaint on the matter to the European Commission in January 2014. The complaint concerned the Sweets Tax’s unequal treatment of equivalent products (plant based beverages and milk), which is considered to constitute unlawful state aid. The Commission reacted to ENSA’s complaint by negotiating with the Finnish Government which finally announced on 29 September 2015 that the Sweets Tax would be changed to respond to the Commission’s state aid concerns.
